InCrawler OR RELATED SERVICES, WITH THE DELAY OR INABILITY TO
USE InCrawler OR RELATED SERVICES, THE PROVISION OF OR FAILURE
TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS,
SERVICES AND RELATED GRAPHICS OBTAINED THROUGH InCrawler, OR
OTHERWISE ARISING OUT OF THE USE OF InCrawler, WHETHER BASED
ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE,
EVEN IF InCrawler OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF
THE POSSIBILITY OF DAMAGES. IF YOU ARE DISSATISFIED WITH ANY
PORTION OF InCrawler, OR WITH ANY OF THESE TERMS OF SERVICE,
YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING InCrawler
AND ITS RELATED SERVICES.
You agree to defend, indemnify and hold InCrawler harmless
from and against any and all claims, losses, liability costs
and expenses (including but not limited to attorneys' fees)
arising from your violation of these Terms of Service (including,
without limitation, violation of applicable Additional Terms
of Service), or any third-party's rights, (including, without
limitation, infringement of any copyright, violation of any
proprietary right and invasion of any privacy rights). These
obligations will survive any termination of your relationship
with InCrawler.
ACCESS RESTRICTION
InCrawler reserves the right to deny in its sole discretion
any user access to InCrawler or any portion thereof without
notice. You are responsible for safeguarding the confidentiality
of your password(s) issued to you by InCrawler, and for any
use or misuse of InCrawler resulting from any third party using
a password issued to you.
TERMINATION
InCrawler may terminate this agreement and your access to any
or all InCrawler services at any time, with or without cause,
effective immediately. Anyone determined by InCrawler to have
violated these Terms of Service and Notices, or any Additional
Terms may be banned from using InCrawler.
ADDITIONAL TERMS
I understand that I use this service at my own risk and that
it is presented as-is with no warranty or guarantee of any kind.
I agree not to hold the provider liable for any damage that
may occur to me, my customers, or anyone involved as a result
of using this service. I am solely responsible for anything
that may occur as a result of using the provider's service. I
agree that a listing in InCrawler will be removed if the URL the
listing points to is inaccessible for more than 2 weeks. I agree
that InCrawler can shut down the directory at any time, with or without cause, effective immediately, without any obligation to notify you or give a refund.
I understand that at times inappropriate sites may appear in
the index from time to time as a result of people abusing the
InCrawler index. I agree to inform the provider when these sites
appear so that they may be quickly removed from the InCrawler
index. I agree not to place my site under an inappropriate category.
I agree not to post to the directory any URLs that contain any
of the following: adult or pornographic materials, excessive
profanity, illegal content of any sort ( including but not limited
to "warez," child pornography, content showing people
how to conduct illegal activities such as hacking, passwords
or serials for commercial products), defamatory content of any
kind, seditious writings, libel, hate propaganda, racist or
otherwise discriminatory content, tools or instructions for
"spamming" of any kind, or anything else which common
sense may dictate as unacceptable for general consumption. I
agree that InCrawler is the sole arbiter of what sites are deemed
acceptable for the InCrawler directory and that InCrawler may
remove my site from the directory without warning or explanation.
In the most extreme cases we may be forced to involve law enforcement
and/or the Internet provider of the hosted site. I understand
that all communications with InCrawler's staff are strictly
confidential. I agree that the information I am using to sign
up is valid, factual, and in good faith. I agree not to sign
up using a false name, fake/invalid email address or alias of
any sort and that doing so constitutes an act of fraud.
